Westchester County also recently passed a tough new law calling for civil forfeiture of motor vehicles involved in DWI, DWAI or drag racing offenses within the county.
If you are convicted of any drunk driving offense in the county, or an illegal speed contest on certain county highways, the Westchester County Attorney can start a separate civil action seeking transfer of title to the vehicle from the owner to the county. Owners subject to forfeiture will have the chance to present a defense, including relief based on "substantial and unwarranted hardship." The new law is effective as of December 10, 2010.
