Ozempic Mass Tort Lawsuit

You trusted Ozempic to help you take control of your health. Instead, you may be battling a debilitating new reality: severe stomach paralysis, constant vomiting, and chronic pain. Your hope has likely turned to fear and confusion as medical bills pile up. This devastating outcome is an injustice you should not have to face alone.  At Greenspan & Greenspan Injury Lawyers, P.C., we have been guiding injured clients through complex legal challenges since 1959, and we understand the turmoil you are experiencing. We are here to provide the direction you need.

The direct answer to the question, “Is there a lawsuit against Ozempic?” is yes. In fact, hundreds of individuals have filed lawsuits against Novo Nordisk, the manufacturer of Ozempic, and Eli Lilly, the maker of a similar drug, Mounjaro.

What Are the Allegations in the Ozempic Lawsuits?

The central claim in the litigation is that the manufacturers knew, or should have known, about the link between their GLP-1 receptor agonist drugs and severe gastrointestinal conditions but failed to provide adequate warnings on the product’s label. While the label mentioned some side effects like nausea and vomiting, plaintiffs argue it did not disclose the risk of more extreme conditions.

The lawsuits allege that this failure to warn prevented doctors from making fully informed prescribing decisions and denied patients the ability to weigh the actual risks against the benefits. As a result, many people suffered devastating health consequences that the manufacturers never told them were possible.

Understanding the Ozempic Lawsuit: Severe Side Effects

The injuries cited in these lawsuits go far beyond mild stomach discomfort. They involve severe, often chronic conditions that drastically impact a person’s quality of life. Understanding these conditions is key to determining if you may have a claim:

  • Gastroparesis. Often called stomach paralysis, this condition slows or stops food movement from the stomach to the small intestine, even though there is no physical blockage. Sufferers experience severe nausea, repeated vomiting of undigested food, abdominal pain, and dangerous fluctuations in blood sugar.
  • Ileus. This condition refers to a lack of normal muscle contractions in the intestines, leading to a buildup and blockage of food. It causes symptoms similar to a physical obstruction, such as abdominal cramping, bloating, nausea, and vomiting.
  • Cyclic Vomiting Syndrome. Characterized by severe, recurring episodes of vomiting and nausea that can last for hours or even days, this condition can lead to dehydration and hospitalization.
  • Intestinal Obstruction. An obstruction is a blockage that prevents food or liquid from passing through the small or large intestine. This condition can become a life-threatening medical emergency requiring immediate intervention.

These conditions often require extensive medical intervention, including hospital stays, powerful medications, and sometimes surgery. They can lead to chronic pain, malnutrition, and a permanent need for a restricted diet, fundamentally changing a person’s ability to live a normal life.

Is This an Ozempic Class Action Lawsuit?

Many people have heard of class action lawsuits, but the Ozempic litigation is structured differently. The court has consolidated the federal cases into a Multi-District Litigation (MDL). While a class action lawsuit and an MDL involve grouping many similar claims, there is a crucial difference.

In a class action, a small group of plaintiffs represents the entire group, and the court divides any settlement or verdict among all class members. In an MDL, however, the court only groups the individual lawsuits for pretrial proceedings like evidence gathering (discovery) and legal motions, which makes the process more efficient.

The specific facts and damages of each case determine any potential settlement. An MDL recognizes that while the core complaint is the same, the severity of each person’s injury and its impact on their life are unique. There is currently no ongoing Ozempic class action lawsuit.

How Do You Know If You Are Eligible to File a Lawsuit?

While every case is unique, there are general criteria that may make you eligible to join the Ozempic MDL. Our attorneys can evaluate the specifics of your situation to determine if you may have a potential claim, based on the following:

  • Used Ozempic, Wegovy, Mounjaro, Rybelsus, or another GLP-1 receptor agonist drug;
  • Were subsequently diagnosed with a serious gastrointestinal condition, such as gastroparesis, ileus, intestinal obstruction, or cyclic vomiting syndrome; and
  • Required medical intervention, such as emergency room visits or hospitalization, for your condition.

It is also essential to act promptly. In New York, the law sets a time limit, known as the statute of limitations, for filing personal injury claims. Generally, you have three years from the injury to file a lawsuit. Investigating a claim takes time, so contacting an attorney as soon as possible is essential to protect your rights.

What Are the Potential Ozempic Lawsuit Settlement Amounts?

Because the litigation is still in its early stages, predicting specific lawsuit settlement amounts is impossible. There have been no public settlements or jury verdicts yet. However, we can look at the damages typically pursued in product liability cases like this one. The goal of a lawsuit is to secure compensation for all the harms and losses a person has suffered, which includes:

  • Medical Expenses. Expenses include the costs of all past and future medical care related to your injury, such as hospital stays, doctor visits, prescription medications, and diagnostic tests.
  • Lost Income. If your condition forced you to miss work or reduced your ability to earn a living in the future, we can pursue compensation for these lost wages and your diminished earning capacity.
  • Pain and Suffering. Compensates you for the physical pain, emotional distress, and mental anguish caused by the injury and its impact on your life.
  • Loss of Enjoyment of Life. A chronic gastrointestinal condition can prevent you from participating in activities and hobbies you once loved, and this damage category seeks to compensate for that loss.

The final value of any individual claim will depend on factors like the severity and permanence of the injury. Our attorneys know how to build a thorough case to demonstrate the full extent of your losses.
