It seeks to recover damages for the injuries and losses the deceased person personally suffered from the moment of the accident until the moment of their death. This claim essentially allows the estate to stand in the decedent’s shoes and pursue the compensation the decedent would have sought had they lived.

  • Pain and suffering—if your loved one survived for any period of time after the injury and experienced conscious pain and suffering, the estate can seek compensation for that agony;

How Much Time Do I Have to File A Wrongful Death Claim?

Wrongful death lawsuits must be filed within two years from the date of the decedent’s death. However, New York recognizes that certain tragedies and legal complexities require more time.

  • September 11th victim extension. Deaths linked to the 9/11 attacks or toxic exposure at Ground Zero carry a 2.5-year statute of limitations. This recognizes that latent illnesses, such as 9/11-related cancers, often took decades to manifest and involve complex medical causation.
  • Pending criminal proceedings. If the state is prosecuting the defendant for the death, such as vehicular manslaughter, you have at least one year from the conclusion of the criminal case to file your civil suit.   • Minor beneficiaries. If a minor is the sole beneficiary of the claim, the statute is paused until the child turns 18 or a legal guardian is appointed. However, if a surviving adult spouse exists, the standard two-year deadline remains in effect.
  • Suing government entities. If the negligent party is a government body, such as a city hospital, the two-year limit still applies, but you must file a notice of claim within 90 days of the personal representative’s appointment.
