White Plains attorney Leon Greenspan (he is retired and no longer practicing law) achieved a great victory in obtaining a verdict in a legal malpractice case against a prominent Connecticut real estate lawyer in a decision after non-jury trial released on June 6, 2013. Judge A. William Mottolese ruled that Attorney Greenspan proved at trial that the real estate attorney had committed legal malpractice when, in searching land records in connection with a boundary dispute, the attorney failed to discover a restrictive covenant. The restrictive covenant would have enabled the attorney to obtain an injunction preventing damages caused by a property owner’s actions in constructing a driveway and removing trees and bushes on land adjoining the plaintiff’s property. The court awarded the plaintiff over $625,000 in damages.
