New York’s Classification System for E-Bikes and E-Scooters

Many people ask, Are electric scooters legal in New York? The answer is yes. Both electric-assist bicycles (e-bikes) and electric scooters are legal to operate in New York State, but are subject to specific laws and regulations that all users must follow. 

To promote safety, New York law classifies e-bikes into three distinct categories based on their functionality and top speed. Electric scooters fall into their own separate category. Knowing which type of device was involved in your accident is crucial, as different rules apply to each.

The law establishes the following classifications:

  • Class 1 E-Bike. This class includes bikes with an electric motor that provides assistance only when the rider is pedaling and ceases to assist when the bike reaches 20 miles per hour.
  • Class 2 E-Bike. A Class 2 e-bike has a motor that can be used to propel the bike exclusively by a throttle and cannot assist when the speed reaches 20 miles per hour.
  • Class 3 E-Bike. This bike, also called a “pedal-assist” e-bike, features an electric motor that provides assistance only when the rider is pedaling, stopping assistance when the bike reaches 25 miles per hour. 
  • E-Scooter. With a maximum speed of 15 miles per hour on a paved, level surface when propelled exclusively by its motor, this device features a floorboard, handlebars, and an electric motor.

Local municipalities, including New York City, have the authority to regulate their use beyond the state’s laws, which can add another layer of complexity to your case.

Navigating New York E-Scooter Laws

Operating an e-scooter or an e-bike comes with responsibilities. Riders must adhere to specific rules of the road designed to prevent accidents and protect everyone, including pedestrians, cyclists, and motorists. Violating these traffic laws can serve as direct evidence of negligence in a personal injury claim. 

In NYC, electric scooter laws are often stricter than those in the rest of the state, and include:

  • Age requirements. Riders must be at least 16 years old to operate any e-bike or electric scooter.
  • Helmet use. 16 and 17-year-olds must wear a helmet on any e-bike or e-scooter, and operators and passengers of Class 3 e-bikes are required to wear helmets, despite their age. For riders 18 and over on Class 1 and 2 e-bikes or e-scooters, a helmet is not legally mandated but is always a critical safety measure.
  • Where to ride. E-bikes and e-scooters are generally permitted in bike lanes and streets with a posted speed limit of 30 miles per hour or less. 
  • Traffic laws. All riders must obey standard traffic laws, including stopping at red lights and stop signs, yielding the right-of-way, and using hand signals when turning.
