Cell Phones and other Portable Electronic Devices (“PED”) are ubiquitous today. You see people using them everywhere–especially behind the wheel of a car.

We all know that it is unsafe and just plain dangerous to do so, but people still use PEDs every day to text, send or check emails or follow directions.  If you are pulled over by the police while using one of these devices, you will receive a ticket.

Using a Cell phone or other Portable Electronic Device while driving in New York will cost you five (5) points on your New York Driver’s license record and subject you to fines and a surcharge:

Fines:

First Violation:   $50-$200

Second Violation in 18 months:  $50-$250

Third Violation or more in 18 months;  $50-$450

Surcharge:  Up to $93.00

License Suspension

If you receive 11 or more points on your license in an 18 month period, your driver’s license may be suspended.

Can I ever use a cell phone while driving and NOT get a ticket?

The only acceptable uses of a cell phone are to call 911 or to contact medical, fire or police personnel about an emergency.

What can a traffic ticket defense attorney do for me?

We go to court and fight the ticket on your behalf so that you don’t have to take time off of work or school and do it yourself.  Traffic courts are often very crowded. You can expect to sit there cooling your heals for a considerable period of time waiting for your case to be called.  Can you spare that time from work or from home especially if the court is located some distance away?

At Greenspan & Greenspan P.C. for a low flat fee

  • We fight the ticket and seek to have it dismissed if there is a basis for doing so.
  • We fight to get the ticket reduced to a lesser point offense or a zero point offense if dismissal is not an option.
  • You do not have to appear in Court (for a non-criminal offense)–we do that for you.
  • Can you afford to have five points on your license?

Just look at the many reviews from satisfied clients of our firm who put their faith in our abilities to defend against traffic tickets in Westchester, Rockland and other counties north of New York City.
