The statute of limitations for a personal injury claim in the state of New York is three years (with certain exceptions). This means that individuals injured in an accident have three years to commence a lawsuit or file a claim if they wish to receive compensation from any at-fault party. While three years may at first sound like a long time, it is nonetheless essential to act fast. New City Personal Injury FAQs

How long do I have to file a personal injury claim in Rockland County?

For most personal injury cases against private parties in New York, you have three years from the date of the accident to file a lawsuit (CPLR §214). Wrongful death cases have a two-year deadline from the date of death. If a government entity was responsible (a county vehicle, a poorly maintained roadoad, a town sidewalk, or a school), you must file a Notice of Claim within 90 days of the accident. Missing that 90-day deadline will permanently bar your lawsuit regardless of injury severity. Contact a Rockland County personal injury lawyer immediately if a government party may be involved.

What is the most common type of personal injury case in Rockland County?

Car and truck accidents are the most common, driven by high traffic volumes on Route 59, Route 45, Route 202, I-87, and the Palisades Interstate Parkway. Slip and fall accidents on commercial properties (particularly along the Route 59 retail corridor and in Spring Valley) are the second most frequent category. Construction accidents are also significant given the active development throughout Ramapo and Clarkstown.

Can I still recover compensation if I was partially at fault for my accident in Rockland County?

Yes. New York follows pure comparative negligence (CPLR §1411). Even if you were partially responsible, your compensation is reduced by your percentage of fault but is not eliminated entirely. For example, if you are 25% at fault and your damages total $200,000, you recover $150,000. Insurance companies routinely try to inflate your fault percentage to reduce their payment. Does New York’s no-fault insurance cover slip and fall and premises liability cases?

No. New York’s no-fault Personal Injury Protection (PIP) system applies only to motor vehicle accidents. You file directly against the responsible property owner, business, or employer, and there is no serious injury threshold to satisfy. The three-year statute of limitations applies.

What if I was injured on a Rockland County road with a pothole or dangerous condition?

If a road defect maintained by Rockland County, the Town of Clarkstown, the Town of Ramapo, or any other municipality contributed to your accident, you must file a Notice of Claim against the responsible government entity within 90 days of the accident. You must also prove that the government knew about the defect and failed to repair it within a reasonable time. Our attorneys identify the responsible entity, file the Notice of Claim on time, and subpoena road inspection and maintenance records to establish prior notice.

The Most Dangerous Roads in Rockland County

Rockland County’s road network combines high-speed interstate highways, congested commercial strips, and rural two-lane routes. This combination that produces crash patterns distinct from urban or purely suburban areas.

Route 59 (West Nyack Road / Main Street corridor): One of the two most dangerous roads in Rockland County. Route 59 at Airmont Road is one of the busiest and most documented crash intersections in the county, recording over 80 accidents and 21 injuries in a single year. The Route 59 corridor between Nanuet and Spring Valley contributes more than 500 crashes to the county’s annual total, with numerous on-ramp and off-ramp conflict points generating rear-end and sideswipe collisions.

Route 45 at Route 59 intersection: Documented as one of the single most dangerous driving locations in all of Rockland County. Over a two-year study period, a 2-mile stretch near this intersection recorded nearly 500 separate accidents, more than 100 injuries, and at least one fatality.

Route 202 near Haverstraw (at Routes 45 and Palisades Interstate Parkway): Frequently cited as experiencing nearly 10 times more vehicle crashes than comparable routes. The multi-route convergence creates complex merge conflicts and poor sight-line conditions.

I-87 (New York State Thruway) through Ramapo: I-87 is among the deadliest roads in New York State. The stretch through Rockland County (from the Suffern interchange north through Ramapo) interchange north through Ramapo) is a high-speed corridor where commercial truck traffic, commuter volume, and insufficient shoulder geometry combine to produce catastrophic crashes.

Palisades Interstate Parkway: The Parkway’s narrow lanes, limited lighting, and seasonal ice conditions make it a consistent crash site, particularly on elevated sections and at the interchanges near Alpine and Rockland Lake.

Route 9W through Haverstraw and Stony Point: A mix of commercial driveways, speed variations, and pedestrian activity across this Hudson River corridor generates both vehicle collisions and pedestrian accidents.
