Leg Injuries in Car Accidents

SCHEDULE A FREE CONSULTATION

You got out of the car and walked away, or thought you did. A day later, your knee had swollen to twice its size, your thigh was deep purple, or you could not put weight on your ankle without sharp pain shooting up your leg. Or the fracture was obvious immediately, and you are now looking at surgery, a cast, months of physical therapy, and a stack of medical bills that your no-fault coverage will not come close to covering.

At Greenspan & Greenspan Injury Lawyers, our Bronx car accident lawyer will build the medical and legal case that reflects the full impact of what a serious leg injury takes from your ability to work, move, and live your life, so the people responsible are held accountable for all of it.

What Types of Leg Injuries in Car Accident Cases Does Our Firm Handle?

These cases involve a wide range of trauma depending on how the crash occurred, where the occupant was sitting, and what part of the vehicle absorbed the impact. Common leg injuries include:

  • Femur fractures. Breaking the strongest bone in the body requires significant force, and femur fractures in car accidents typically result from direct dashboard impact or crushing injuries. Surgery, intramedullary nailing, and extended non-weight-bearing recovery are standard.
  • Tibia and fibula fractures. Lower leg fractures range from stable breaks that heal with immobilization to complex fractures requiring surgical fixation, bone grafts, and months of rehabilitation.
  • Knee injuries. Torn anterior cruciate ligaments, posterior cruciate ligaments, meniscus tears, and patellar fractures are common in frontal and side-impact crashes. Many require arthroscopic or reconstructive surgery and carry long-term mobility consequences.
  • Hip fractures and dislocations. High-speed impacts can drive the femoral head into the hip socket or fracture the pelvis and hip, causing injuries that frequently require joint replacement and carry serious long-term functional limitations.
  • Ankle and foot fractures. Foot and ankle injuries often result from impact with the brake pedal or the floor during a collision. Complex ankle fractures involving multiple bones frequently require surgical repair and extended immobilization.
  • Nerve damage. The peroneal nerve, which runs along the outer knee and controls foot movement, is vulnerable in side-impact crashes and crush injuries. Peroneal nerve damage can cause foot drop, a condition in which the patient cannot lift the front of the foot, permanently affecting gait.
  • Soft tissue injuries. Torn ligaments, muscle tears, and deep contusions may not appear on an X-ray. Still, they can cause lasting pain, instability, and functional limitations that rival those of fractures in their long-term impact.

The type of injury matters because it shapes both the treatment required and the legal threshold analysis under New York law.

Why Do Some Leg Injuries After a Car Accident Show Up Days Later?

Adrenaline and inflammation do not always behave predictably after a crash. While it is not uncommon for injuries to appear well after the initial impact, creating a medical record immediately is important to any claim. An attorney can help you understand what to document and how to communicate your symptoms so nothing that matters gets left out of the record.

Don’t Wait to See the Doctor

Soft tissue injuries, including ligament tears, deep muscle damage, and joint injuries, frequently produce minimal symptoms immediately after impact and become significantly more painful and swollen in the 24 to 72 hours that follow. Nerve injuries sometimes produce numbness or weakness that the person initially attributes to shock or general soreness from the accident rather than recognizing it as a distinct injury requiring evaluation.

What most people with soft tissue leg injuries do not realize until it is too late is that the medical record created in the days immediately after the accident is the foundation of the causation argument. Insurance defense teams in New York routinely challenge soft tissue leg injuries by arguing that MRI findings reflect pre-existing degeneration rather than trauma from the crash.

What Happens When You Do Wait?

When a person waits a week to seek treatment, that gap becomes the defense’s primary evidence that the injury either was not serious or did not result from the accident. Seeing a physician the same day or the day after the crash, describing every symptom completely, and returning for follow-up as symptoms develop are the steps that protect the claim, not just the physical recovery.

How Does New York’s Serious Injury Threshold Apply to Leg Injuries?

New York’s no-fault system pays for immediate medical expenses and a portion of lost wages regardless of fault. Still, it does not compensate for pain and suffering or permanent impairment. To pursue those damages in a third-party claim, the injury must meet New York’s serious injury threshold.

Leg injuries frequently satisfy that threshold under multiple categories:

  • A fracture qualifies as a serious injury under the statute, meaning any diagnosed bone fracture in the leg, knee, hip, ankle, or foot automatically clears the threshold;
  • Permanent consequential limitation of use of a body organ or member covers lasting knee instability, permanent foot drop, hip replacement limitations, or any other measurable loss of leg function; and
  • A significant limitation in the use of a body function or system includes documented impairment that affects mobility, gait, the ability to stand or climb, or the capacity to perform work requiring physical activity.

Soft tissue injuries require objective medical evidence to satisfy the threshold. MRI findings, range-of-motion measurements, and physician records documenting functional limitation all contribute to establishing that the injury meets the legal standard.

A fracture that heals cleanly may still qualify and support a meaningful claim if it required surgery, caused missed work, or left any residual limitation.

What Compensation Can a Car Accident Leg Injury Claim Recover?

Damages in these cases cover several categories depending on the severity and permanence of the injury and include:

  • Medical expenses—emergency care, hospitalization, surgery, orthopedic follow-up, physical therapy, and future medical treatment for the injury;
  • Lost wages—income lost, including partial wage loss when the injury limits the type of work the person can perform;
  • Lost earning capacity—inability to perform prior occupation or reduction in long-term earning potential;
  • Pain and suffering—physical pain, mobility limitations, and emotional impact of the injury, including the loss of activities the person could perform before the accident; and
  • Future medical costs—anticipated surgeries, joint replacements, ongoing physical therapy, and adaptive equipment costs over the person’s life.

The difference between what no-fault pays and what a serious leg injury costs over time can be substantial. No-fault covers basic medical expenses up to the policy limit. It does not touch pain and suffering, lost earning capacity, or the future cost of a knee replacement that a surgeon has already indicated will be necessary in five years.

How Does Medical Documentation Affect a New York Leg Injury Lawyer’s Ability to Build Your Claim?

The strength of a leg injury claim depends directly on what the medical record shows. Consistent treatment, specific functional assessments, and objective diagnostic findings give an attorney the documentation needed to establish both the nature of the injury and its impact on the person’s life.

After seeking immediate medical care, injured people should follow all referrals and attend all scheduled appointments. Gaps in treatment give defense attorneys a basis to argue that the injury resolved or was not as serious as claimed. A physical therapist’s notes documenting that a patient cannot climb stairs, stand for more than 20 minutes, or return to a physically demanding job carry direct legal weight. Orthopedic surgeon records recommending future surgical intervention are included in the damages calculation.

Every appointment missed is a gap in the record that the defense will use, and every appointment kept is evidence that strengthens your case. Our firm works alongside your treatment team from the beginning to make sure the legal and medical records tell the same complete story.
